The ArtInclude online store, located on the domain name artinclude.com, hereinafter referred to as the "Commission Agent", publishes a Public Offer to place the Goods in its Goods database for its subsequent sale.
1.Definition of terms
1.1. Public offer (hereinafter referred to as the “Offer”) is a public offer of the Commissioner, addressed to an indefinite circle of persons, to conclude a commission agreement with the Commissioner for the sale of goods by remote means (hereinafter referred to as the “Agreement”) on the terms contained in this Offer, including all Annexes.
1.2. Seller - an individual or legal entity interested in placing the Goods on the website of the online store.
1.3. A product is a tangible thing that is suitable for placement on the website of the online store and corresponds to the theme of the existing product sections. First of all, these are objects of fine and / or decorative art.
1.4. Online store manager - a representative of the Seller who communicates with the Buyer via e-mail or telephone.
2. General provisions
2.1. The Seller accepts this Offer at the time of sending data about the Goods using a special form "Sell the work".
2.2. The administration of the website of the online store has the right to make changes to the Offer without notifying the Buyer. At the same time, the previous version of the Offer is valid for one calendar day.
2.3. The validity period of the Offer is not limited, unless otherwise specified on the website of the online store.
2.4. The commission agent provides the Seller with services for placing the Goods on the website of the online store.
2.5. The Seller transfers to the Commission Agent a non-exclusive right to sell objects of fine and/or decorative art.
3. Adding a product to the database
3.1. The addition of the Goods is carried out by the Seller through the section of the online store "Sell work".
3.2. The Seller provides the Commissioner with complete and reliable information about the Goods, including information about the main consumer properties of the Goods.
3.3. When placing the Goods, the Seller guarantees that he owns the exclusive rights to the Goods (unless otherwise applicable).
3.4. When sending the work, the Seller undertakes to provide the following registration information:
3.4.1. surname and name (own or legal representative);
3.4.2. E-mail address;
3.4.3. contact number.
3.5. When sending the work, the Seller undertakes to provide the following information about the Goods:
3.5.1. the author of the work, as well as, if necessary, the biography of the author;
3.5.2. technique in which the work is done;
3.5.3. width;
3.5.4. height;
3.5.5. year;
3.5.6. images of the Goods (up to 10 photos, while the photos must be clear - without the participation of people and animals in the frame);
3.6. If the Commissioner needs additional information about the Goods, he has the right to request it from the Seller.
3.7. The Seller is responsible for the accuracy of the information provided when registering the addition of the Goods to the database of the online store.
3.8. The Seller has no right to sell an art object posted on the Seller's website independently or through other agents at a cost lower than that indicated on the Seller's website.
3.9. The Seller has no right to place in other galleries the Products presented on the Seller's website.
4. Product price
4.1. The price of the Goods is indicated in a special field of the "Price" form.
4.2. The Commissioner has the right to unilaterally change the price for any position of the Goods, but only not lower than the price indicated by the Seller.
4.3. In the event of a change in the price of the added Goods, the Seller undertakes to inform the Commissioner about this within 3 days and name the new price.
5. Sales and Transaction Process
5.2. The Commissioner undertakes to notify the Seller about the beginning and end of negotiations with potential buyers of the Goods.
5.3 The commission agent is obliged to notify the Seller of the sale of an object of art through the site within 5 days from the date of the purchase and sale transaction.
5.4 In the event of the sale of the Goods through the website of the Commissioner, the Seller undertakes to transfer it to the Seller under the act. Transportation to the actual address of the Seller or the buyer is carried out at the expense of the Seller or as agreed by the parties.
5.5. The seller undertakes, if necessary, to provide permission
Ministry of Culture of the Russian Federation, necessary for the customs clearance of the Goods when
exporting it outside the Russian Federation eras.
6. Commissions and cash settlements
6.1. Commission for the placement of the Goods on the website of the online store is not charged.
6.2. The commission for the sale of the Goods on the website of the online store is 30 percent of the value of the goods (after taxes).
6.3. In the event of the sale of the Goods and full receipt of payment from the Buyer for the Goods, the Commission Agent informs the Seller about this fact within 3 working days. In this case, the Commission Agent transfers funds to the Seller within 14 calendar days, minus all commissions specified in the Offer.
7. Removal of goods from sale
7.1. The commission agent has the right to independently remove the art object from sale.
7.2. If the Seller wants to remove the Goods from sale on the website of the online store, he informs the Seller about it. In turn, the seller withdraws the Goods from sale within 1 working day. This clause is suspended for the duration of negotiations between the Commissioner and a potential buyer of the Goods.
7.3. In the event that the Goods are withdrawn from sale, the Seller pays a commission to the seller's settlement account for placement on the website of the online store (clause 5.3).
